By creating an account, accessing, or otherwise using the Kriya Stack platform, which includes Kriya Learn and iKriyate Storyboard (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms").
If you are an individual accessing the Platform on behalf of a business entity (a "B2B Customer"), you represent and warrant that you have the requisite authority to bind that entity to these Terms. If you do not agree to these Terms, you must not access or use the Platform.
You must be at least 18 years of age to register for an Account. By creating an Account, you guarantee that the information provided is accurate, current, and complete.
You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. Account sharing, resale, sublicensing, or transferring of credentials to unauthorized third parties is strictly prohibited and constitutes a material breach of these Terms.

We reserve the right to modify, suspend, or discontinue any feature of the Services at any time with reasonable notice to Subscribers.
Free Trial: We may offer a Free Trial to new users, granting an initial allocation of credits to experience the Platform. Usage is limited to the credits provided and does not convert into a Subscription Plan or incur an obligation to pay upon exhaustion of those credits. Any unused credits during a Free Trial do not roll over or hold cash value.
Subscription Plans: Continued usage beyond the Free Trial period requires the purchase of a Subscription Plan. Subscription Plans dictate the features, export capabilities, and credit limits available to the Subscriber. Upgrades or downgrades to your Subscription Plan take effect in accordance with the billing cycle terms displayed during purchase. All Subscription Plans renew automatically unless canceled prior to the end of the current billing cycle.
Fees and Auto-Renewal: By selecting a Subscription Plan, you authorize Kriyatoonz to charge the applicable subscription fees on a recurring basis (e.g., monthly or annually).
Payment Processing: Transactions are securely processed through designated third-party payment infrastructure. Kriyatoonz Private Limited does not store raw credit card information and shall not be held liable for delayed or failed transactions caused by third-party processor disruptions.
Taxes: Fees are generally displayed exclusive of taxes. The User is responsible for any applicable taxes, including GST (India), VAT (EU/UK), and regional sales taxes, which will be added to the total due during checkout.
Enterprise Licensing: Custom pricing, licensing scope, Service Level Agreements (SLAs), and renewal terms for large B2B deployments are exclusively governed by separate written and fully executed Enterprise Licensing agreements, which supersede these standard Terms in the event of a conflict.
Failed Payments: In the event of a failed payment, access to your Account features restricting Generation Capabilities and exports may be immediately suspended until the outstanding balance is settled.
All refund requests are reviewed and evaluated on a case-by-case basis at the strict and sole discretion of Kriyatoonz Private Limited. There are no automatic or inherently guaranteed refunds for partial usage or unused credits.
To formally request a refund, Users must contact us at sushant@kriyaanimation.com. Factors considered during evaluation include the technical nature of any reported issue, the extent of platform usage within the billing cycle, and the time elapsed since the transaction.
This policy does not override or supersede any statutory consumer refund rights strictly mandated by your local jurisdiction which cannot be contractually waived.

Kriyatoonz Private Limited makes no warranties, express or implied, concerning the factual accuracy, completeness, historical precision, absolute originality, or legal fitness for a particular purpose of any Generated Output.
Generated Outputs do not constitute professional, legal, medical, technical, or copyright advisory. Users are solely and exclusively responsible for reviewing, editing, legally validating, and confirming the appropriacy of Generated Outputs before any form of publishing or internal business deployment.
Our data collection, processing, security protocols, and use of personal information are detailed comprehensively in our Privacy Policy. By agreeing to these Terms, you also consent to the data practices as described therein.
For B2B Customers operating within regions requiring elevated data protection contracts (such as the EU/UK under the GDPR), an overarching Data Processing Agreement (DPA) is available upon written request.
The Platform inherently relies on industry-leading third-party cloud infrastructure and enterprise AI providers (including Microsoft Azure, AWS, and GCP) for hosting, processing, and output delivery.
These providers operate under their individual terms of service. Subject to applicable law, Kriyatoonz Private Limited is not intrinsically liable for outages, systemic failures, downtime, or data transmission incidents originating solely from external third-party infrastructure disruptions.
We strive to offer a highly available platform ("best-efforts" uptime). However, except where specifically defined within a separate Enterprise License SLA, we do not formally guarantee uninterrupted or completely error-free service availability.
We reserve the right to perform scheduled and emergency maintenance, aspiring to provide reasonable advanced notice whenever practical. Kriyatoonz is not liable for secondary or primary productivity losses arising from unforeseeable or unplanned Platform downtime.
User Termination: You hold the right to cancel your Account and Subscription Plan at any time. Cancellations will become fully effective at the conclusion of your current, prepaid billing cycle.
Kriyatoonz Termination: We reserve the right to immediately suspend or restrict your Account, without a refund, if you breach our Acceptable Use Policy, fail to fulfill financial obligations, or act unlawfully.
Following Termination: Access to the Platform ceases. Kriyatoonz may delete uploaded Content following a 30-day grace period. Furthermore, the active commercial license granting use of Generated Outputs is formally revoked. Clauses concerning Intellectual Property, Limitation of Liability, Indemnification, and Dispute Resolution shall inherently survive termination.
To the maximum extent fully permitted under applicable law, the aggregate liability of Kriyatoonz Private Limited, its affiliates, employees, or directors for any claims arising out of or related to these Terms or the Platform shall not exceed the total fees successfully paid by you in the three (3) months directly preceding the initiation of the claim.
In no event shall Kriyatoonz be liable for any indirect, incidental, consequential, special, punitive, or reliance damages—including, but not limited to, lost business profits, data loss, or business operational interruptions—regardless of the foundational theory of liability (contract, tort, negligence).
You agree to indemnify, rigorously defend, and hold wholly harmless Kriyatoonz Private Limited and its officers, directors, employees, and designated agents against all third-party claims, liabilities, damages, and legal expenses (including reasonable attorney fees) arising directly or indirectly from:
To the absolute fullest extent permitted by statutory law, Kriyatoonz Private Limited provides the Platform entirely on an "as-is" and "as-available" basis. We emphatically disclaim all direct, express, implied, or statutory warranties. This unequivocally includes disclaimers relating to the warranty of merchantability, absolute fitness for a distinct particular purpose, system integration, and non-infringement.
Kriyatoonz vehemently reserves the intrinsic right to unilaterally modify these Terms at our discretion. For sweeping, material changes actively reducing your legal rights, we will provide a minimally requisite 14 days' written notice, dispatched via email or robust within-Platform notification.
Continued engagement with the Platform following the expiration of the notice period constitutes an irrefragable acceptance of the modernized Terms.
If any distinct provision of these Terms is legally mandated by an authorized court to hold zero enforceability, the remaining structural provisions naturally persist in absolute, unmitigated effect.
A failure by Kriyatoonz to fiercely enforce a specific right or statutory provision embedded within these Terms does not ever constitute an outright waiver of such right. These Terms, combined collectively with our Privacy Policy, encapsulate the entire, sole operational agreement existing between Kriyatoonz and the User.
In dutiful compliance with the requisite Indian Information Technology Act parameters, Kriyatoonz dictates that any escalated grievances be forwarded to our Grievance Officer, ensuring an initial acknowledgment timeframe of 24 hours and standard resolution closure spanning 30 days.
